Changes to these Legal Conditions shall not have retroactive effect.

2. The Restaurante Casa Obdulia website

1. Services offered

The Web Site is a free platform where users can access information about Restaurant Casa Obdulia and book a table at the Restaurant, as well as receive information about events and activities organized by Restaurant Casa Obdulia.

Also, Casa Obdulia reserves the right to modify at any time the organization and design of the Web Site, the services offered and the Contents.

2. Access and use by users

The user, by accessing and using the Website, agrees to:

  1. to facilitate, in case it is necessary to fill in a form, truthful and updated information. The user is solely responsible for any false or inaccurate statements and the damages that, as a result, may be caused to Restaurante Casa Obdulia or third parties;
  2. not to provide Restaurante Casa Obdulia or introduce in any form the personal data of third parties, unless you have the explicit consent of the third parties to do so;
  3. use the Web Site without contravening the Legal Conditions, current legislation, good faith, generally accepted uses and public order; and

4. EXCLUSION OF WARRANTIES AND LIABILITY OF RESTAURANTE CASA OBDULIA

Restaurante Casa Obdulia provides access to the Web Site, services and Contents with a reasonable level of competence and diligence. Restaurante Casa Obdulia does not assume any contractual obligation other than those arising from the Legal Conditions. Restaurante Casa Obdulia makes no warranties and is not responsible, in any case, for any damages that may arise from:

  1. the lack of availability, maintenance and correct, continuous and uninterrupted operation of the Website, its services and/or Contents. For these purposes, the user acknowledges that the Internet is a medium subject to malfunctions and interruptions of service;
  2. the lack of compatibility of the Website with the user’s devices, including computers, browsers, mobile devices, tablets, etc…;
  3. lack of usefulness, appropriateness or validity in meeting the needs, activities, specific results or expectations of users;
  4. the truthfulness, accuracy and validity of user data;
  5. the existence of malicious or harmful programs in the Contents and/or services of the Web Site that may alter the user’s software and hardware;
  6. the infringement of intellectual and industrial property rights, image and data protection rights or any other right of a third party as a consequence of the use of the Contents by the user; and
  7. discrepancies that, on a transitory basis, may arise between the electronic Contractual Relationship and the paper version that the user may print.
5. Intellectual and industrial property

The intellectual and industrial property rights or any other rights existing or which may exist on the Web Site and the Contents appearing on the Web Site are the exclusive property of Restaurante Casa Obdulia. Access to and use of the Web Site and acceptance of the Legal Conditions do not grant or attribute any rights to users over the intellectual and industrial property rights of Restaurante Casa Obdulia. In particular, any form of distribution, reproduction, public communication, transformation or any other act on the intellectual and industrial property rights of Restaurante Casa Obdulia is forbidden, unless the user has the prior and express authorization of Restaurante Casa Obdulia.

In addition, the trademarks, trade names or distinctive signs of any kind that appear on the Web Site (the “Trademarks“) are the exclusive property of Restaurante Casa Obdulia. Users may not use the Trademarks without the prior and express authorization of Restaurante Casa Obdulia.

Any citation or reference to intellectual and industrial property rights of third parties implies the recognition of Restaurante Casa Obdulia in favor of their owners.

6. Possible actions of Restaurante Casa Obdulia in case of breach of the contractual relationship by the user.

Although Restaurante Casa Obdulia has no obligation to supervise the actions of users on the Website, in the event of non-compliance by users of the Contractual Relationship, the law or the infringement of the rights of third parties, including intellectual and industrial property rights, image rights and data protection rights, Restaurante Casa Obdulia will be able to:
  1. withdraw, cancel and/or denounce before the competent authorities any actions of the users;
  2. deny the user access and use of the Web Site. In such a case, Restaurante Casa Obdulia will communicate to the user the denial of access or use;
  3. adopt, at its sole discretion and judgment, such measures as it deems appropriate for the best operation of the Web Site and Restaurante Casa Obdulia, including restrictions on access to or use of the Web Site and, in cases of maximum severity, restrict access to the Restaurante Casa Obdulia sports center; and
  4. claim from the user the corresponding amounts for the damages caused as a consequence of the above breaches.
7. Privacy policy and cookies policy
The personal data of users will be processed by Restaurante Casa Obdulia in its capacity as data controller in accordance with its Privacy Policy and its Cookies Policy.
8. Applicable Law and Jurisdiction

The Legal Conditions will be governed by the Spanish common law, excluding any rules on conflict of laws. Users and Restaurante Casa Obdulia submit, renouncing any other jurisdiction that may correspond to them, to the Judges and Courts of the city of Barcelona, Spain in relation to any dispute over the validity, effectiveness, compliance, interpretation, execution or any other matter relating to the Contractual Relationship.

In the event that the users are consumers, the courts of their domicile shall have jurisdiction in application of the regulations in force.

In case of discrepancies between the versions of the Legal Conditions in the different languages in which these documents are available, the Spanish version shall prevail, whenever legally possible. Likewise, the declaration of nullity or invalidity of any clause shall not affect the validity and effectiveness of the other clauses, which shall be interpreted and applied in the closest lawful sense to that which would derive from the application of the null clause.
